TERMS AND CONDITIONS OF USE
Please read these terms and conditions carefully before using these services. By using these services, you acknowledge that you have agreed to become a party to and legally bound by these terms and conditions.
GENERAL INFORMATION
The agent, owner, developer or builder (further referred to as the client) must be present at the scheduled time of the photography session and remain onsite until the completion of the shoot.
First Impression will photograph the home as-is. That is, we will not move, straighten or dust objects, open or shut windows or doors or stage in any way. The photographer will, however, adjust lighting or blinds if it results in a better image.
The locations of all 360° scenes and still images will be selected at the discretion of the photographer (unless otherwise pre-arranged with the photographer).
All 360° scenes will be added to virtual tours unless First Impression deems it to the client’s best interest not to exhibit a particular scene. This may be the result of poor lighting, bad weather, unkempt room, etc.
First Impression will select the best images to present to the client and reserves the right to select images based on composition, visual appeal, angle, lighting, etc.
Virtual tours, slideshows and single property websites are only posted to the internet when all necessary information is provided. This may include realtors email, web address, office address, applicable phone numbers, MLS number, asking price, property address, square footage, number of bedrooms and bathrooms etc. First Impression is not responsible for any delays that are the result of missing or incorrect information.
Once a virtual tour, slideshow or website is created, the client will be provided with a link to the tour for the marketing purposes of that property and it may not be transferred to another agent without paying an additional license fee.
The virtual tour, slideshow or website will remain active for one year after the tour is created. First Impression reserves the right to charge an annual fee (upon client notification) for any tour that requires additional hosting and/or domain name renewal.
CANCELLATION POLICY
A $125 fee will be billed to the client if; the client cancels on the same day, does not reschedule, or if no one is at the property for the scheduled appointment time within 10 minutes thereafter. We schedule tightly and efficiently. Anything that defers, throws everyone's schedule off. Your attention to time is very much appreciated.
Once the home has been photographed, the tour or photography package may not be refunded. The client will be billed the full price. If the client is not happy with the photographs taken of a home, a re-shoot may be requested. The photographer will re-take and edit pictures of the same home at an hourly rate of $250.
First Impression reserves the right to update these Terms and Conditions at any time without notice
INVOICING
Payment is due upon invoice receipt.
COPYRIGHT
This license is individual, non-transferable and non-exclusive. It gives you unlimited use of the images for print, internet and other marketing of the property displayed in the photos for the life of the original listing. The images are for use by the above named client only and you may not re-sell, rent, loan, give, sublicense, or otherwise transfer to anyone, including another selling agent, marketing company, rental business or accommodation advertising. You agree to take all commercially reasonable steps to prevent third parties from reproducing, duplicating or distributing the images. Before any other use of the photographs is permitted, it is mandatory to contact First Impression Virtual Tours and Photography in order to pay an additional license fee.
If a listing expires, or is taken off the market for a period of time and taken over by another realtor, the new realtor must pay a usage fee to First Impression Photography before they can use the images. The previous realtor does not have permission to share the photos with anyone and is not entitled to a refund.
All rights to the photographs are owned by First Impression Virtual Tours and Photography. The granting of this license does not imply a transfer of ownership. First Impression also reserves the right to use any of these photos as portfolio and marketing materials.
Any transfer, representation or reproduction other than the marketing of the property photographed, complete or partial carried out without the consent of First Impression Virtual Tours and Photography can be considered a copyright violation.
